Terms of service
These Terms of Service ("Terms") govern your purchase of products from THE MOST LOS ANGELES at themostlosangeles.com. By placing an order, you acknowledge that you have read and agree to be bound by these Terms, together with our Shipping & Returns and Product Warranty pages, which are incorporated by reference.
Orders. Your order constitutes an offer to buy. We may accept or decline any order at our discretion, and a contract is formed only when we send a written order confirmation. We do not guarantee that any product listed will be available for purchase.
Prices, taxes & delivery costs. All prices are in U.S. dollars and are based on the prices shown at the time of purchase. Listed product prices do not include delivery, special handling, storage, insurance or assembly, which are shown separately at checkout. Applicable state and local taxes are calculated at checkout based on your delivery address.
Payment. Unless otherwise agreed, orders are paid in full at the time of purchase and prior to delivery. By submitting payment information you represent that you are at least eighteen years of age and authorized to use the payment method provided. Payments are handled by a third-party payment processor.
Delivery & risk. Delivery is made within the United States to the address on your order. Estimated delivery dates are not binding. Benefit and all risk of loss or damage pass to you upon delivery. If delivery cannot be completed because the item does not fit, you are not present, or delivery is refused, you may be responsible for resulting re-delivery, restocking and storage charges.
Returns & warranty. Inspection, returns and warranty are governed by our Shipping & Returns and Product Warranty pages.
Limitation of liability. To the maximum extent permitted by law, our total liability for any claim shall not exceed the purchase price of the product giving rise to the claim, and we are not liable for any consequential, indirect, special, punitive or incidental damages or lost profits.
Indemnification. You agree to indemnify and hold us harmless from claims arising out of your misuse of any product, or use contrary to manufacturer instructions, except to the extent caused solely by defects in materials or workmanship or our sole negligence.
Force majeure. We are not liable for any failure or delay in performance due to causes beyond our reasonable control.
Governing law. These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute shall be brought exclusively in the state or federal courts located in Los Angeles County, California.
